The School Board of Escambia County, Florida, convened in Public Forum at 5:30 p.m., in Room 160, at the J.E. Hall Educational Services Center, 30 East Texar Drive, Pensacola, Florida, with the following present:

Mrs. Stidham called the
Regular Meeting to order at 6:35 p.m. The Superintendent listed the
additions, deletions, corrections and amendments to the agenda. (see margin notes) On motion made by Dr. DeWitt and seconded by
Mr. Clark, adoption of the agenda (as
amended), was approved unanimously.

of Karen Montgomery, from Curriculum Coordinator/Blue Angels Elementary School
to Assistant Elementary Principal/Blue Angels Elementary School, effective July
28, 2004, was approved unanimously.

accept the Superintendent’s recommendation for the administrative appointment
of Russell Queen, from Principal/Carver Century K-8 School to Principal/West
Pensacola Elementary School, effective July 1, 2004, was approved unanimously.
Motion by Dr. DeWitt, seconded by Mr. Bergosh, to accept the Superintendent’s

Motion by Dr. DeWitt, seconded by Mrs. Stidham, to

of Steven Schubert, from Intervention Specialist/West Pensacola Elementary
School to Assistant Elementary Principal/West Pensacola Elementary School,
effective July 28, 2004, was approved unanimously.
Motion by Ms. Finkelstein, seconded by Dr. DeWitt,
to accept the Superintendent’s recommendation for the administrative
appointment of Michael Sherrill, from Teacher/Woodham High School to Assistant
Principal/Northview High School, effective July 28, 2004, was approved
unanimously.
Motion by Dr. DeWitt, seconded by Ms. Finkelstein,
to accept the Superintendent’s recommendation for the administrative
appointment of Margaret Warr, from Teacher/Wedgewood Middle School to Assistant
Principal/Wedgewood Middle School, effective July 28, 2004, was approved
unanimously.

Recognition of Bob Husbands, Former Executive Director, Escambia NEA
On behalf of the Board, Mrs. Stidham presented a plaque to Mr.
Husbands, in appreciation for his “faithful and dedicated representation of the
employees of the Escambia County School District, as Executive Director of the
Escambia NEA from June 1987 to June 2004.”

Foreign Language in Elementary
School Proposal (Information Only)
[NOTE: This issue
was previously addressed at the June 15, 2004 Regular Meeting under “K-12
Foreign Language Program” (Item V.A.8.).] Motion was made by Dr.
DeWitt, seconded by Mr. Bergosh, “that
the information item that the Superintendent provided become an action item and
that the Board implement the proposal as submitted.” The Superintendent advised that this proposal
was brought forth at the Board’s request (June
15, 2004 Regular Meeting) however, he would not recommend its
implementation, simply because of the cost.
(It was noted that the minimum
funding estimate for each year of the program was approximately $200,000, with
a cumulative cost of over $1.2 million once the program was fully implemented
K-5.) Board Members (other than Dr. DeWitt) indicated that
while they “liked” the proposal, they did not believe that it was something that
the District could afford to implement at that time. Motion failed 4 to 1, with Mrs. Stidham, Mr.
Bergosh, Mr. Clark and Ms. Finkelstein voting “No.”

Mrs. Stidham moved to “withhold action on this item until the
Superintendent followed the correct policies and procedures to implement this
recommendation.” Ms. Finkelstein seconded
the motion for discussion purposes. Mrs.
Stidham explained her reason for believing that action on this item should be
withheld until the Superintendent followed the correct procedures outlined in
Board policy with regard to this recommendation. Motion failed 3 to 2 with Dr. DeWitt, Mr.
Bergosh and Mr. Clark voting “No.”
Motion by Dr. DeWitt, seconded by Mr. Bergosh to approve this item, was
approved 3 to 2, with Mrs. Stidham and Ms. Finkelstein voting “No.”

therefore, did not feel comfortable supporting its approval. After further discussion, motion was approved

Motion was made by Ms.
Finkelstein, seconded by Mrs. Stidham, to reject “Bid Award: Hydraulic Lift
Replacement at the Walnut Hill Bus Garage.”
Ms. Finkelstein read the following memorandum, addressed to the
Superintendent and dated July 27, 2004, into the record:
I must state my surprise in learning that the above item is listed on
this month’s agenda as a request to award a bid. It is a well established fact that this Board
requested and was given assurances that an RFP for the lift replacement would
be shared with the Board prior to the issuance of an RFP. At School Board meetings in January,
February, April and May of 2004 this issue was discussed, many times in great
detail. It should have been obvious that
the Board had many concerns regarding this issue.
Prior to receiving this month’s agenda (Friday, July 16, 2004) I had
not been apprized of any requests, RFP’s, detailed information, budget
resolutions, etc., pertaining to the “moving forward” in the acquisition of
equipment as requested repeatedly at the Board table. The only information in the agenda packet,
aside from the executive summary sheet, is a one sheet bid tabulation that
essentially only outlines name of bidder and cost associated with the
project.
I am now left with many unanswered questions with regard to the entire
process used for moving forward with your recommendation which began in January
2004 as an emergency request for an expenditure of approximately $90,000. Not only does it appear that no true
emergency existed but now the project has grown to the point of equipment
replacement alone being over $128,000 for an alternate, not the original bid specification. From yesterday’s workshop I learned that the
issue of contaminated soil has not reached closure, which was and still should
be the first priority. Detailed information
such as vendor, cost, disposal procedure, projected dates of inspections, etc.,
on this issue would have been helpful for a complete review of the entire
project. Although questions were asked
yesterday, there still was not a clear explanation of the details of the bid
process that was used in soliciting bids for the replacement equipment and
installation. Without having the
opportunity to make inquiries prior to the item appearing on this month’s
agenda, (request for information made numerous times), and without appropriate
backup information being submitted with the agenda item, (which should have
been obvious would have been needed, based again on numerous previous requests
made at the Board table) I can not support this purchase.
I understand that there will be comments suggesting that I don’t fully
understand the requirements for this particular piece of equipment. My answer to that is that many attempts were
made by me to acquire the information needed for appropriate review and I have
sought out experts within the field who have offered less costly suggestions
that I believe should have been explored.
I understand that there will be comments suggesting that I am attempting
to micromanage. My answer to that is
that although $128,000 plus may seem like a small amount within a budget as
large as the School District’s, it is my responsibility to assess each
budgetary item as carefully as I can regardless of the dollar amount. By the way, $128,000 could go a long way in
addressing many facility needs within this School District.
We all recognize that the facility in question, although District
property, is situated in the District I represent. As such, I want to make sure that all
facilities in District 5 are equipped with everything needed to provide for a
safe learning and work environment while also maintaining the integrity of the
budget from which the entire District must operate. Again, not having been afforded the insight
others working on the project may have had, I am not convinced that this is the
most economical and efficient manner in which to address the problem.
Ms. Finkelstein stated that
she had visited Santa Rosa County School District to review their above ground
lift system which was purchased in March 2003 at a cost of approximately
$18,000.00 (NOTE: Santa Rosa had
received three bids for an above ground lift, ranging from approximately
$18,000 to $21,000.) She noted that
when she questioned Santa Rosa staff as to why they had purchased an above
ground lift as opposed to an in-ground lift, she was told that it was because
above ground lifts were safer and less expensive to operate. Ms. Finkelstein did not understand why staff
was recommending the purchase of an in-ground lift at a cost of approximately
$128,000, when a “cheaper and safer alternative” (referring to an above ground
lift) was available. Mr. Shawn
Dennis, Assistant Superintendent for Operations, advised that staff had visited
a local car dealership to review and assess their above ground lift system (as suggested by Ms. Finkelstein at the
February 16, 2004 Special Meeting) and had determined that there were
numerous safety implications of using an above ground lift versus an in-ground
lift. While he acknowledged that an
in-ground lift was significantly more expensive, it was his and staff’s professional
opinion “that an in-ground lift was inherently, ergonomically safer than an
above ground lift when it comes to our bus inspectors and our technicians
working on that bus.” As suggested by
Mrs. Stidham, Mr. Dennis indicated that he would schedule a time for
transportation staff to visit to Santa Rosa County School District to review
and assess their above ground lift system.
Dr. DeWitt moved to postpone this item until the August Regular Meeting,
at which time additional information should be provided. Motion was seconded by Mr. Bergosh and
approved 4 to 1, with Mrs. Stidham voting “No.”
Ms. Finkelstein requested that the Board be notified once the visit with
Santa Rosa County School District was scheduled.

the recommendations contained in the report, in written format, for

The response should list each recommendation from the Task Force Report,
indicating the District’s recommendation or proposal. Any information germane to the individual
recommendations should be stated in the report and should include whether or
not the recommendation has already been implemented, is in the process of being
implemented, needs policy drafted, cannot be implemented and why, how it
correlates with the Strategic Plan and any budgetary implications. This information can then be digested in an
appropriate setting so that the School Board can act upon specific issues.” Motion was seconded by Mr. Clark and approved
unanimously.

presentation at the August Regular Meeting regarding “soil contamination and clean
up” at Brown Barge Middle School. Also
to request that during the presentation, the Superintendent provide “scenarios
for relocation, including the total cost of moving the program for each
scenario.” Mr. Clark seconded the
motion. Mrs. Stidham advised that her
motion “was not any recommendation to actually relocate the program, but rather
just scenarios to be provided in case we do need them in the future.”
The Board recognized the following speakers, who
expressed their thoughts regarding this issue: Linda Fussell, Wendy Manderson,
Marcia McCrary and Sheila Romaine.

recommendation for expulsion of student number 04-165-1251 for the remainder
of the 2003-2004 school year and all of the 2004-2005 school year be rescinded
and that the student be allowed to return to regular school enrollment for
the 2004-2005 school year.
