MINUTES, AUGUST 17, 2004
The School Board of Escambia County, Florida, convened in Public Forum at 5:30 p.m., in Room 160, at the J.E. Hall Educational Services Center, 30 East Texar Drive, Pensacola, Florida, with the following present:

Mrs. Stidham called the Public Forum to order at 5:30 p.m.
Mr. Wayne Odom gave the invocation and Mrs. Peggy Pilcher led the pledge of allegiance.

I. CALL TO ORDER/ADOPTION OF AGENDA
Mrs. Stidham called the Regular Meeting to order at 6:00 p.m. Mr. Ross listed the additions, deletions, and amendments to the agenda. (see margin notes) On motion made by Dr. DeWitt and seconded by Mr. Bergosh, adoption of the agenda (as amended), was approved unanimously.
II. PROPOSED ADDITIONS OR REVISIONS TO SCHOOL DISTRICT RULES
(Supplementary Minute Book, Exhibit “B”)
A. Permission to Adopt
Motion by Dr. DeWitt, seconded by Mrs. Stidham, to remove this item from the table, was approved unanimously. Motion was made by Ms. Finkelstein and seconded by Mr. Clark, to adopt this item. Mrs. Stidham called for public hearing, however there were no speakers. Motion was approved 4 to 1, with Mr. Bergosh voting “No.”
2. Notice of Intent to Adopt Revision to School District Rule 6Gx17 – 7.02 – Code of Conduct: Secondary Rights and Responsibilities Handbook Revisions 2004-2005 (previously tabled at the
July 27, 2004 Regular Meeting)
Motion by Dr. DeWitt, seconded by Ms. Finkelstein, to remove this item from the table, was approved unanimously. Motion was made by Mr. Clark and seconded by Dr. DeWitt, to adopt this item. The following motions were made in order to amend various sections of the handbook:
Dr. DeWitt offered a motion to include the following amendment:
Under Section C “Right To Have Access” (page 26):
The
school will share the records with the parents of the student within thirty
(30) days as soon as possible, but shall not exceed thirty (30) calendar
days.
Motion was seconded by Ms. Finkelstein and approved unanimously.
Mrs. Stidham offered a motion to make the following amendments:
Under Section VII “Serious Breach of Conduct” (page 20):
25. Use of any unauthorized wireless communication device from arrival on school district property until the end of the school day.
Under Section IX “Very Serious Breach of Conduct” (page 22)
21. Possession or intent to sell or distribute any substance which may have the appearance or is purported to be an illegal/controlled substance.
22. Use of any unauthorized wireless communication device in any manner which disrupts the normal operation of school. Motion was seconded by Ms. Finkelstein and approved unanimously.
The Board recognized Sheila Romaine and Elizabeth Shasteen, who expressed their thoughts regarding various aspects of this item.
Motion to adopt this item (as amended) was approved 4 to 1, with Mr. Bergosh voting “No.”
3. Notice of Intent to Adopt Amendment to School District Rule 6Gx17 – 7.17 – Student Dress Code (to run concurrent with the proposed revisions updating the 2004-2005 Elementary and Secondary Rights and Responsibilities Handbooks –previously tabled at the July 27, 2004 Regular Meeting)
Motion by Dr. DeWitt, seconded by Mr. Bergosh, to remove this item from the table, was approved unanimously. Motion was made by Dr. DeWitt and seconded by Mr. Bergosh, to adopt this item. The following motions were made in order to revise various sections of the rule amendment:
Dr. DeWitt offered a motion to include the following
revision under Section 4(A), “Uniforms - Election”: (3) Each current
student (K-4), (6-7 middle school), (9-11 high school), will represent one
vote. The student’s name shall appear on the ballot. The ballot must be
signed by a parent/guardian. The parent/guardian shall have one week (10
calendar days) ten (10) calendar days to return the ballots. Mr.
Bergosh seconded the motion.
The Board recognized Sheila Romaine, who offered several suggestions regarding Section 4, “Uniforms”.
Motion was approved unanimously.
Dr. DeWitt offered a motion to include the following
revision under Section 4(A,) “Uniforms – Election”: (6) After
a period of two (2) years During the second year of implementation
of the school-wide uniform policy, the principal shall confer with the school’s
School Advisory Council (SAC) to determine whether there is a continued interest
in the school-wide uniform policy at the school. Mr. Bergosh seconded
the amendment for discussion purposes. Dr. DeWitt noted that this revision
would allow a principal to discuss the uniform policy with the School Advisory
Council (SAC) during, rather than after, the second year of implementation.
Motion was approved unanimously.
Motion to adopt this item (as amended) was approved unanimously.
4. Notice of Intent to Adopt Emergency Amendment to School District Rule 6Gx17 – 7.15 – Cell Phones and Other Electronic Devices (as mandated by Legislature – previously tabled at the
July 27, 2004 Regular Meeting)
Mr. Bergosh moved to remove this item from the table. Motion died for lack of a second.
B. Permission to Advertise
1. Notice of Intent to Advertise Amendment to School District Rule 6Gx17 – 7.15 – Cell Phones and Other Electronic Devices (as mandated by Legislature –previously tabled at the
July 27, 2004 Regular Meeting)
Mr. Bergosh moved to remove this from the table. Motion died for a lack of a second.
2. Notice of Intent to Advertise Amendment to School District Rule 6Gx17 – 3.07 – Safety Regulations and Procedures (previously tabled at the July 27, 2004 Regular Meeting)
Motion by Dr. DeWitt, seconded by Mr. Bergosh, to remove this item from the table, was approved unanimously. Motion by Dr. Dr. DeWitt, seconded by Mr. Bergosh, to approve the advertisement of this item, was unanimous.

The Board recessed at 6:30 and reconvened at 6:45 p.m., with all Board Members, Mr. Ross, and Mrs. Odom present.
ADD Report on Soil Investigation at Brown Barge Middle School
Mr. Steve Sharp, Coordinator of Safety, Health and Environmental Operations, gave a brief report regarding the soil investigation at Brown Barge Middle School. [NOTE: This report was requested by the Board at the July 27, 2004 Regular Meeting.]
Mr. Shawn Dennis, Assistant Superintendent for Operations, reviewed information provided regarding options (including estimated costs and time frames) for possible relocation of the Brown Barge Program. [NOTE: This information was requested by the Board at the July 27, 2004 Regular Meeting.]
THE FOLLOWING ITEM WILL BE MOVED FORWARD: Administrative Appointment (Item VII.B.1)
Motion by Ms. Finkelstein, seconded by Mr. Bergosh, to accept the Superintendent’s recommendation for the administrative appointment of Frank Howell, from Teacher in Charge/Lakeview Center, to Principal/Clubbs, effective August 2, 2004, was approved unanimously.
