MINUTES, SEPTEMBER 27, 2004
The School Board of Escambia County, Florida, convened in Public Forum at 5:30 p.m., in Room 160, at the J.E. Hall Educational Services Center, 30 East Texar Drive, Pensacola, Florida, with the following present:

NOTE: This meeting was originally scheduled for September 21, 2004, but later rescheduled to September 27, 2004, due to the arrival of Hurricane Ivan (September 15, 2004).
Mrs. Stidham called the Public Forum to order at 5:30 p.m.
Mrs. Peggy Pilcher gave the invocation and Mr. Ronnie Clark led the pledge of allegiance.
Mrs. Sheila Romaine addressed the Board regarding School District Rule 6Gx17-3.07 - Safety Regulations and Procedures. (Item II.A.1, “Notice of Intent to Adopt Revision to School District Rule 6Gx17-3.07 – Safety Regulations and Procedures”)
Mrs. Stidham called for public forum; however, there were no speakers.
I. CALL TO ORDER/ADOPTION OF AGENDA
Mrs. Stidham called the Regular Meeting to order at 5:40 p.m. The Superintendent listed the additions, deletions, and amendments to the agenda. (see margin notes) He then requested that Item V.E.1.B.1, “Tentative District Facilities Work Program (Five-Year Plan)” be moved forward on the agenda. On motion made by Dr. DeWitt and seconded by Mr. Bergosh, adoption of the agenda (as amended), was approved unanimously.

Mrs. Stidham called for a motion on this item; however, no motion was offered.

Motion was made by Ms. Finkelstein and seconded by Mr. Clark, to adopt a revision to School District Rule 6Gx17-3.07 – Safety Regulations and Procedures.
The Board recognized Sheila Romaine, who expressed her thoughts regarding this rule revision.
Motion was approved unanimously.
2. Notice of Intent to Adopt Addition of School District Rule 6Gx17-2.39 – Deceased Employee Account
Motion was made by Mr. Bergosh and seconded by Ms. Finkelstein, to adopt the addition of School District Rule 6Gx17-2.39 – Deceased Employee Account. Mrs. Stidham called for public hearing; however, there were no speakers. Motion was approved unanimously.
3. Notice of Intent to Adopt Revision to School District Rule 6Gx17-2.06 – Other Contractual Personnel
Motion was made by Mr. Bergosh and seconded by Ms. Finkelstein, to adopt a revision to School District Rule 6Gx17-2.06 – Other Contractual Personnel. Mrs. Stidham called for public hearing; however, there were no speakers. Motion was approved unanimously.
B. Permission to Advertise

Motion made by Mr. Bergosh and seconded by Mr. Clark, to approve the advertisement of a revision to School District Rule 6Gx17-2.17(4) – Terminal Pay, was unanimous.

Motion made by Ms. Finkelstein and seconded by Mr. Bergosh, to approve the advertisement of a revision to School District Rule 6Gx17-2.05(1) – Ethics, was unanimous.
THE FOLLOWING ITEM WAS MOVED FORWARD:
Administrative Appointments (Item VII.B.1)
Motion by Mr. Bergosh, seconded by Ms. Finkelstein, to accept the Superintendent’s recommendation for the administrative appointment of Brent Brummet, from Intern Principal/Bailey Middle School, to Assistant Principal/Brownsville Middle School, effective August 18, 2004, was approved unanimously.
Motion by Ms. Finkelstein, seconded by Mr. Bergosh, to accept the Superintendent’s recommendation for the administrative appointment of Mona Evans, from Teacher/Bellview Middle School to Subject Area Specialist/Intervention Services, effective September 13, 2004, was approved unanimously.
Motion by Mr. Bergosh, seconded by Mr. Clark, to accept the Superintendent’s recommendation for the administrative appointment of Esther Smith to Subject Area Specialist/Autistic & EH Programs, effective September 13, 2004, was approved unanimously.

Mr. Bergosh moved to accept the Superintendent’s recommendation of instructional appointments, but noted that he would abstain from voting on the appointment of his wife, Carissa Bergosh. Motion was seconded by Ms. Finkelstein and approved unanimously. Mrs. Odom advised that the preceding action was inappropriate and therefore, would need to be reconsidered. Motion by Ms. Finkelstein, seconded by Mr. Bergosh, to reconsider the action taken under Item V.C.1.a, was approved unanimously. Motion was then made by Ms. Finkelstein and seconded by Mr. Clark, to accept the Superintendent’s recommendation of instructional appointments, with the exception of the appointment of Carissa Bergosh. Motion was approved unanimously. A separate motion was then made by Mr. Clark and seconded by Ms. Finkelstein, to accept the Superintendent’s recommendation for the instructional appointment of Carissa Bergosh. Motion was approved 4 to 0, with Mr. Bergosh abstaining from vote.

Schedule for Harold Smith who is on military leave of absence in

For Board Information: The District will be requesting approval to pay regular hourly rate of pay to approximately 180 instructional personnel to work Beyond the School Day Program for six hours per week for 18 weeks. The program will be funded by Title I funds reserved under provisions of the No Child Left Behind Act for the benefit of students in schools not making “adequate yearly progress” (AYP).
8. Request approval for Dale Kite, teacher at West Florida High to teach Welding at the Detention Center (Road Prison) through George Stone for the 2004-05 school year and to be paid at his regular hourly rate of pay funded by the Sheriff’s Department.
9. Request approval to establish the job description on the Professional Salary Schedule for Energy Educators Manager.
Motion was made by Dr. DeWitt and seconded by Mrs. Stidham, to postpone this item. After brief discussion, Mrs. Stidham offered a “friendly amendment” to the motion on the floor, to postpone this item until the October Regular Meeting. Dr. DeWitt accepted the “friendly amendment” and the motion (as amended) was approved unanimously.
10. Request approval to amend the following page in the 2004-05 Department Personnel
Planning Document to reflect the noted change:

Motion by Mrs. Stidham, seconded by Mr. Clark, to postpone this item to the October Regular Meeting, was approved unanimously.

At the request of Mrs. Stidham, various staff members gave brief status reports on the following areas that were affected by Hurricane Ivan: facilities, curricula, calendar, and sporting events. The Superintendent advised that classes would resume on October 11, 2004.

Motion by Ms. Finkelstein, seconded by Mr. Clark, to accept the Superintendent’s recommendations for student expulsions, Items 1 through 23, was approved unanimously.
1. Recommend that, consistent with the decision of the formal hearing officer, student number 04-235-1221 be adopted as the order of the Escambia County School Board and that the student be expelled from the public schools of Escambia County for the remainder of the 2003-2004 school year and all of the 2004-2005 school year with the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.
2. Recommend that, consistent with the decision of the due process committee, student number 04-291-061 be expelled from all public schools of Escambia County for the remainder of the 2004-2005 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.
3. Recommend that, consistent with the decision of the due process committee, student number 04-299-601 be expelled from all public schools of Escambia County for the remainder of the 2004-2005 school year. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.
16. Recommend that, consistent with the decision of the due process committee, pursuant to the authority of Section 232.26(2), Florida Statutes, student number 05-01-281 be suspended from all classes of instruction on public school grounds during regular classroom hours until such time as the pending criminal charges are concluded, at which time the Superintendent will make a further recommendation regarding suspension, expulsion, or re-enrollment of this student. The indefinite suspension provided herein shall not affect the delivery of educational services to the pupil, and the pupil should immediately enrolled in a day-time alternative educational program.

Recommend that, consistent with the decision of the due process committee, student number 05-02-061 be expelled from all public schools of Escambia County for the remainder of the 2004-2005 school year and all of the 2005-2006 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.
18.
