MINUTES, DECEMBER 18, 2001
The School Board of Escambia County, Florida, convened in Public Forum at 6:00 p.m., in Room 160, at the J.E. Hall Educational Services Center, 30 East Texar Drive, Pensacola, Florida, with the following present:

Dr. DeWitt called the Public Forum to order at 6:05 p.m.
INVOCATION AND PLEDGE OF ALLEGIANCE
Prior to the invocation and pledge of allegiance, the Board observed a moment of silence in remembrance of Mr. John Webb, Chorus Director at Pensacola High School, who had recently passed away. Mr. Darriel White gave the invocation and Deputy Dan Schock led the pledge of allegiance.
PUBLIC FORUM
Although not an agenda item, the Board agreed to allow the following presentation:

The Superintendent and Board presented Mr. Sandy Sansing, Sandy Sansing Chevrolet, with a plaque in recognition of his generosity in providing new vehicles for use in Drivers Education classes (Drivers Education Vehicle Lease Annual Agreement) and for his continued support of public education.

I. CALL TO ORDER
Dr. DeWitt called the Regular Meeting to order at 6:50 p.m.
II. ADOPTION OF AGENDA
The Superintendent listed the additions, deletions and amendments to the agenda. (see margin notes) On motion made by Dr. Jenkins and seconded by Ms. Finkelstein, adoption of the agenda as amended, was unanimously approved.

Motion was made by Dr. Jenkins and seconded by Ms. Finkelstein, to approve the minutes as listed (Items 1-6). At the request of Mr. Negron, Dr. DeWitt stated that approval of the minutes for November 16, 2001 (Item 4) would be postponed to the January Regular Meeting to allow for further review by the Board. Motion to approve the minutes [Items 1-6 (excluding Item 4)] was unanimously approved.
IV. COMMITTEE REPORTS
1. Stellar Employee Recognition
The Superintendent announced that Mrs. Elsa Sjolander, Media Specialist at N.B. Cook Elementary School, was the Stellar Employee for the month of December. Mrs. Sjolander has worked for the district for nine (9) years, with the last four (4) years at N.B. Cook Elementary. In addition to working to make her media center a user-friendly, up-to-date and efficient learning environment, Mrs. Sjolander manages the Accelerated Reader Program for her school. She also produces a monthly informative newsletter entitled The Library Lowdown which keeps teachers and families informed as to daily library activities. Mrs. Sharon Sudduth, Principal, N.B. Cook Elementary, accepted a plaque and pin from the School District and a check in the amount of $100 donated by Members First Credit Union, on behalf of Mrs. Sjolander, who was unable to attend.
2. PTA Presentation
Ms. Karen Pope, President, Escambia County Council PTA (ECCPTA), gave a brief update of the recent activities of the PTA. She reminded the Board of upcoming events (i.e., Reflections competition and Founders Day Luncheon and Program Showcase) and expressed her appreciation to the Board for their support of ECCPTA.
3. Citizens Advisory Committee (CAC) for Facilities Cary Stidham
Mrs. Stidham stated that the committee had discussed items relating to facilities that were pending for this meeting and recommends approval of those items. She stated that the committee also discussed performance contracting and would discuss the One-Half Cent Sales Tax Extension at their meeting in January.
V. CONSENT AGENDA
Item V.C.1.f.4 was pulled from the Consent Agenda for separate vote, due to speakers who requested to address the Board concerning that item. On motion by Ms. Finkelstein and second by Dr. Jenkins, the Consent Agenda, except for item pulled was unanimously approved.

ADD 4. Request approval of the attached final School District Calendar for the 2002-2003 school year
Dr. DeWitt moved to approve the final School District Calendar for the 2002-2003 school year, with the following changes:
1) Designate January 3 as Break Day and January 6 and 7 as 10 Month Instructional Days beyond students (in-service days)
2) Elimination of Presidents Day (February 17) as a Holiday and addition of Memorial Day (May 26) as a Holiday
3) Eliminate April 21 as a Break Day, change April 18 from Break Day to Holiday identified as Spring Break and identify March 17 through March 21 as March Break rather than Spring Break
Motion was seconded by Mr. Bergosh. Dr. DeWitt explained the reasoning for the proposed changes, noting that they may foster bargainable issues, which would be resolved by the unions and the District upon approval of the calendar. Dr. Jenkins expressed concerns regarding the financial impact of the proposed changes to the calendar and suggested that the calendar (with proposed changes) be reviewed by the calendar committee prior to Board approval.
The Board recognized the following speakers who expressed various concerns regarding this issue:
Elizabeth Burdek, Sheldon Dykes, Bob Husbands, Madonna Jackson-Williams, Ellen Lawrence*, Ron Knowlton, Mike Horgan, Susan Watson, Sharon Davis, Arlene Costello, Debra Drum, Teresa Watford. (*At the request of Ms. Finkelstein, the Board unanimously agreed to allow Ellen Lawrence one additional minute to complete her presentation.)
Ms. Finkelstein stated that although she did support the motion, she did not believe that parents and employees had been adequately advised on the impact of the calendar.
Dr. Jenkins offered a substitute motion to postpone approval of the calendar for sixty (60) days. Substitute motion was seconded by Ms. Finkelstein. Upon inquiry by Mrs. Stidham, Mr. Paul Fetsko, Assistant Superintendent for Curriculum and Instruction, stated that postponing approval of the calendar for sixty (60) days would adversely affect scheduling for high schools, noting that scheduling would begin on February 1, 2002. Dr. Jenkins moved, and Ms. Finkelstein seconded, to amend the substitute motion to postpone approval of the calendar for 30 days and in the interim refer it to the calendar committee.
The Board recognized Gail Husbands, who expressed her concerns regarding this issue.
Amended substitute motion was approved 3 to 2, with Dr. DeWitt and Mr. Bergosh voting No.

1. School Board Rule 6Gx17-2.17(7) FAMILY SICK LEAVE TRANSFER
Motion was made by Mr. Bergosh, seconded by Mrs. Stidham, to adopt School Board Rule 6Gx17-2.17(7) Family Sick Leave Transfer. Dr. DeWitt called for public hearing, however there were no speakers. Motion was unanimously approved.
2. School Board Rule 6Gx17-7.16 MOMENT OF SILENCE
Motion made by Mr. Bergosh, seconded by Mrs. Stidham, to adopt School Board Rule 6Gx17-7.16 Moment of Silence. Dr. DeWitt offered a substitute motion, to adopt School Board Rule 6Gx17-7.16 Moment of Silence, which would read as follows:
1. Every student shall observe one minute of silence in each class at the commencement of every school day to reflect on the days activities.
2. During the minute of silence:
a. Each student shall:
a. Remain seated and silent;
b. Make no distracting display; and/or
c. Not interfere with, distract or impede other pupils in the exercise of individual choice; and,
b. No person, employee or agenda of the district shall:
a. Coerce, advocate or encourage in any way whatsoever prayer or any religious activity by pupils;
b. Discourage in any way whatsoever prayer or any religious activity by pupils.
3. School principals, or their designees, shall initiate the minute of silence for the entire student body via the public address system.
Substitute motion was seconded by Ms. Finkelstein. Dr. DeWitt stated that he believed that the proposed changes were more restrictive and would give students less discretion. Mrs. Stidham did not believe that a student could be required to remain seated during the Moment of Silence and noted that enforcement of that restriction would burden teachers. Mr. Bergosh noted that the purpose of the rule was to give students an opportunity for a moment of silent reflection on the anticipated activities of the day and believed that students should not be forced to remain seated during that time.
The Board recognized Madonna Jackson-Williams who suggested that the Board develop a policy to discipline students who violate the rule.
Substitute motion failed 3-2, with Mr. Bergosh, Mrs. Stidham and Dr. Jenkins voting No. Original motion was approved 4 to 1, with Ms. Finkelstein voting No."

Motion by Dr. Jenkins, second by Ms. Finkelstein, to approve the Superintendents recommendations for student expulsions, Items 1 through 14, 16 through 23, 26, and 27, and to grant a formal hearing request for Items 15, 25, 28, and 29, was unanimous.

1) Recommend that, consistent with the decision of the formal hearing officer, student number 02-22-851 not be expelled from all public schools of Escambia County.
2) Recommend that, consistent with the decision of the due process committee, pursuant to the authority of Section 232.26(2), Florida Statutes, student number 02-36-561 be suspended from all classes of instruction on public school grounds during regular classroom hours until such time as the pending criminal charges are concluded, at which time the Superintendent will make further recommendation regarding suspension, expulsion, or re-enrollment of this student. The indefinite suspension provided herein shall not affect the delivery of educational services to the pupil, and the pupil should be immediately enrolled in a day-time alternative educational program.
3) Recommend that, consistent with the decision of the formal hearing officer, student number 02-41-521 be expelled from all public schools of Escambia County for the remainder of the 2001-2002 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.
4) Recommend that, consistent with the decision of the due process committee, student number 02-47-951 be expelled from all public schools of Escambia County for the remainder of the 2001-2002 school year and all of the 2002-2003 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.
5) Recommend that, consistent with the decision of the due process committee, student number 02-48-591 be expelled from all public schools of Escambia County for the remainder of the 2001-2002 school year and the entire 2002-2003 school year. Motion by Dr. Jenkins, second by Ms. Finkelstein, to approve the Superintendents recommendation of Mrs. Barbara Linker as Assistant Superintendent of Finance and Business Affairs effective January 2, 2002, was unanimous. The Superintendent asked Ms. Linker to come forward to be recognized by the Board.
ADD 4. Recommend approval of contract for Mr. Mike Burns effective January 2, 2002
Motion was made by Mrs. Stidham, seconded by Mr. Bergosh, to accept the Superintendents recommendation for approval of contract for Mr. Mike Burns, effective January 2, 2002. Dr. Jenkins and Ms. Finkelstein expressed concerns regarding the amount of the contract and the current financial situation of the District. In answer to Ms. Finkelsteins inquiry, Mr. Bergosh stated that the Citizens Advisory Committee (CAC) for Finance did not meet this month and therefore, had not reviewed this particular contract. Mr. Bergosh expressed his support of the contract, noting that he believes the District needed to have a voice in the Legislature. The Superintendent noted that many school districts have two or three similar positions representing them in the Legislature and believed that the District needed to be represented in the Legislature. The Board recognized Ms. Madonna Jackson-Williams, who expressed her concerns regarding this issue.
Dr. DeWitt believed that the contract as presented was open-ended, with no accountability in terms of performance. He also expressed concerns regarding the amount of the contract and the current financial situation of the District and stated that he would not support the motion to approve.
The Board recognized Mr. Bill Caplinger, who expressed his concerns regarding this issue.
Motion was approved 3 to 2, with Dr. DeWitt and Ms. Finkelstein voting No.
