MINUTES, JUNE 18, 2002
The School Board of Escambia County, Florida, convened in Public Forum at 6:00 p.m., in Room 160, at the J.E. Hall Educational Services Center, 30 East Texar Drive, Pensacola, Florida, with the following present:

Dr. DeWitt called the Public Forum to order at 6:00 p.m.
Mrs. Peggy Pilcher gave the invocation and Mr. Carl Leiterman led the pledge of allegiance.
As a reminder of the need for adequate public education funding, Dr. DeWitt read the following passage from the Florida State Constitution, Article IX, Section 1, Public Education: The education of children is a fundamental value of the people of the State of Florida. It is, therefore, a paramount duty of the State to make adequate provision for the education of all children residing within its borders. Adequate provision shall be made by law for a uniform, efficient, safe, secure and high quality system of free public schools that allows students to obtain a high quality education and for the establishment, maintenance, and operation of institutions of higher learning and other public education programs that the needs of the people may require.
The Board and Superintendent took the opportunity to congratulate all Escambia County schools, teachers and students for fantastic FCAT (Florida Comprehensive Assessment Test) scores.
Dr. DeWitt called for public forum however, there were no speakers.
I. CALL TO ORDER
Dr. DeWitt called the Regular Meeting to order at 6:03 p.m.
II. ADOPTION OF AGENDA
The Superintendent listed the additions, deletions and amendments to the agenda. (see margin notes) He explained that Item V.C.6 The Charter Agreement between the School Board of Escambia County, Florida and Dixon Elementary School had been deleted from the agenda due to numerous changes and requested that a Special Board Meeting be scheduled in July to handle that particular item. Ms. Finkelstein added Item VII.B.5 Staffing Requests. On motion made by Ms. Finkelstein and seconded by Mrs. Stidham, adoption of the agenda as amended, was unanimously approved.
At the request of the Superintendent, the following item was moved to the front of the agenda:

Motion was made by Mrs. Stidham, seconded by Ms. Finkelstein, to accept the Superintendents recommendations for Administrative Appointments/Transfers (effective July 1, 2002). Dr. Jenkins expressed his concerns regarding the appointments/transfers for Wedgewood Middle School. Motion was unanimously approved. At the request of the Superintendent, those individuals in attendance, came forward to be recognized by the Board.

IV. COMMITTEE REPORTS
1. PTA Presentation
Ms. Karen Pope, President, Escambia County Council PTA (ECCPTA), gave a brief update of the recent and upcoming activities of the PTA and expressed her appreciation to the Board and the Superintendent for their support.
2. Citizens Advisory Committee (CAC) for Finance Gary Bergosh
Mr. Bergosh stated that the committee had discussed items relating to finance and purchasing that were pending for this meeting and had reviewed Book I and Book II of the 2002-2003 Proposed Budget.
3. Citizens Advisory Committee (CAC) for Facilities Cary Stidham
Mrs. Stidham stated that the committee had discussed items relating to facilities that were pending for this meeting. She further stated that the committee discussed and would like to be involved with the District in the promotion initiative for the One-Half Cent Sales Tax Extension.

Ms. Finkelstein made the following statement: As a point of clarification the Board approved the Superintendents recommendation for the 2002-2003 Personnel Planning Document, with amendments by the Board, at its meeting on April 26, 2002. Therefore, the District does have an approved Personnel Planning Document for 2002-2003 and there is no need to request approval to complete submission. The Superintendent may at anytime request Board approval for changes or amendments to the currently approved Personnel Planning Document and I would suggest that the wording of this recommendation be changed to reflect that issue. She then made the following motion regarding the Personnel Planning Document:
1) On page 9 Approval of establishment of Coordinator EEOC position
2) On page 9 Reject addition of Administrative Secretary II position
3) On page 18 Approval to add notation regarding funding source for thirty-two (32) Teacher Assistant Special (Bus Aides)

5) On page 22 Approval to reestablish two (2) Accountant II positions and one (1) Accountant III position

She further moved that the 2002-2003 Personnel Planning Document approved by the Board on April 26, 2002 be amended to reflect the above changes. Motion was seconded by Dr. Jenkins. After discussion among staff, the Superintendent and the Board regarding clarification of intent, the motion was approved 4 to 1, with Dr. Jenkins voting No.

ADD 21. Request approval for Joel Day, athletic director, Northview High to work 5 days during the month of June to help align schedules, work on gender equity and to be paid at his regular hourly rate of pay from the athletic budget

Motion by Dr. DeWitt, seconded by Ms. Finkelstein, to table Item V.C.1.f.23, Request approval to establish job description for Manager VII Central Shipping and Receiving, was unanimous.
*Dr. DeWitt questioned whether the Superintendent had a recommendation for appointment to the position of Coordinator EEOC. (NOTE: Item V.C.1.f.18 Request approval to establish the attached job description for Coordinator-EEOC was approved as a part of the Consent Agenda). Mrs. Stidham questioned whether a recommendation for appointment to that position could be made at the present time, noting that the position vacancy had not been advertised. Dr. Doug Garber, Director of Human Resource Services, noted that School District Rule states that all promotional positions for administrative personnel would be advertised. He explained that this would be considered a de-motional position for the individual (Elvin McCorvey) that held the position under the previous job description of Director IIA Affirmative Action and therefore, would not require advertisement. The Superintendent presented his recommendation for appointment of Elvin McCorvey to the position of Coordinator EEOC. On motion by Dr. Jenkins, second by Dr. DeWitt, the Superintendents recommendation for appointment of Elvin McCorvey to Coordinator EEOC, was unanimously approved.

Motion was made by Ms. Finkelstein, seconded by Dr. Jenkins, to approve for advertising, School District Rule 6Gx17-3.02(5) Transportation Zones for School Choice. Upon inquiry by Mrs. Stidham, Mr. Ireland Brock, Director of Pupil Instructional Support Services, stated that this rule would establish transportation zones at elementary, middle and high school levels for eligible students to exercise the option (as provided by Section 1002.38 and 1002.39, Florida Statutes), to transfer to another public school with transportation provided by the District. After discussion, Dr. DeWitt moved to amend School District Rule 6Gx17-3.02(5), to include the statement transfer is approved subject to permanent building capacity. Motion to amend was seconded by Ms. Finkelstein and approved unanimously. Original motion to approve for advertising, School District Rule 6Gx17-3.02(5) Transportation Zones for School Choice (as amended), was unanimous.

Motion by Ms. Finkelstein, seconded by Dr. Jenkins, to adopt emergency School District Rule 6Gx17-3.02(5) Transportation Zones for School Choice, with the addition of the statement transfer is approved subject to permanent building capacity, was unanimous.

1. Appointment to Escambia County Planning Board John DeWitt
Motion made by Dr. DeWitt, seconded by Dr. Jenkins, to appoint Ms. Linda Finkelstein to the Escambia County Planning Board, was unanimous.
2. Agenda John DeWitt
Dr. DeWitt moved that the Board direct the Superintendent, to ask staff to pursue obtaining an RFI (request for information) with costs, for the Board to consider at the July Regular Board Meeting to implement the eAgenda. Mr. Bergosh seconded the motion for discussion purposes. Dr. DeWitt explained that eAgenda was a method used by several school districts in Florida, for the electronic submission and posting of agendas and supporting documentation, to a web-site specifically designated for such. He believed that there could be a cost savings associated with implementing a method such as eAgenda, noting that it could reduce the cost of copying many sets of agenda books. He believed that it could also increase public awareness regarding agenda items, noting that the public would also have access to the designated web-site. Mrs. Stidham stated that she could support the motion if it were amended to include a cost savings analysis. Dr. DeWitt and Mr. Bergosh accepted the inclusion of a cost savings analysis as a friendly amendment. Mr. Bergosh stated that while he believed that this method could be a great opportunity for the public and was the wave of the future, he did have concerns regarding the associated costs. In response to concerns expressed by Mr. Barry Boyer, Purchasing Manager, Dr. DeWitt and Mr. Bergosh agreed to a friendly amendment to change the date from July to August. Motion to direct the Superintendent, to ask staff to pursue obtaining an RFI (request for information) with costs and a cost savings analysis, for the Board to consider at the August Regular Board Meeting to implement the eAgenda, was approved unanimously.
ADD 3. Amendment to the Pensacola Beach Elementary School Charter Agreement John DeWitt
NOTE: This issue was discussed at the June 6, 2002 Special Meeting
Motion was made by Dr. DeWitt to approve the funds ($200,000) for the multi-purpose room for the Pensacola Beach Elementary School and that the funds convey to Pensacola Beach Elementary School on June 30, 2002 for execution and planning for said purpose. Funds for project will not be expended until an Attorney Generals opinion is received concerning whether building with tax dollars on lease property is legal. (NOTE: Board action from the June 6, 2002 Special Meeting directed Mr. Negron to seek an opinion from the Attorney General regarding whether One Half Cent Discretionary Sales Surtax funds under Section 212.055(6) Florida Statutes may be used to fund the Capital Improvement Project, General Renovations project for Pensacola Beach Elementary School.) Upon inquiry by Dr. DeWitt, Mr. Negron stated that he had not submitted a request to the Attorney General, noting that at the request of the school (Pensacola Beach Elementary) we are not making that request until they have had the time to cooperate with us on developing. In response to inquiries by Mrs. Stidham and Mr. Bergosh, Mr. Negron stated that Section 212.0556 (Florida Statutes) does not permit you to convey funds from sales tax proceeds to this charter school but rather provides for you to build projects - use that money to build facilities, not simply convey the funds. Mr. Negron stated that in his opinion, the motion on the floor was unlawful and one that this Board cannot undertake at this time. After discussion, Dr. DeWitt withdrew his motion and Mr. Bergosh withdrew the second.
Motion was made by Dr. DeWitt, seconded by Mr. Bergosh, to proceed with the Capital Improvement Project, General Renovations with a project budget of $200,000, as approved by the School Board of Escambia County on April 22, 1997, provided that no funds shall be expended by the District towards this project until such time as an opinion issues from the Attorney General indicating that One Half Cent Discretionary Sales Surtax funds under Section 212.055(6) Florida Statutes may be used to fund said project. Upon inquiry by Mrs. Stidham, Mr. Negron stated that he believed that the motion makes it clear that you cannot expend any money towards the project until you get an Attorney Generals opinion now what does that do to the statement that youre going to proceed basically it stops it but youve expressed your intent to move forward with it.
The Board recognized Jim Blastos, Chairman of the Governing Board for Pensacola Beach Elementary School, who urged the Board to support the motion on floor.
Motion was approved 4 to 1, with Dr. Jenkins voting No.
ADD 4. Ultimate PEP Rally Gary Bergosh
NOTE: This item was discussed at the May 21, 2002 Regular Meeting
Motion was made by Mr. Bergosh, seconded by Mrs. Stidham, to allow the Ultimate PEP Rally, (as outlined in the information provided to the Board) to occur during the 2002-2003 school year. Dr. DeWitt offered a substitute motion that the School Board commend the organizers of the Ultimate PEP Rally for their concern, vision and leadership for the safety and welfare of our students and that the School Board strongly endorse the message of non-violence, civility and respect in our schools and our communities and that the School Board recognize the efforts of the organizers of the Ultimate PEP Rally by permitting the event to be held on individual school sites during school hours or after school hours, to permit both students and their working parents to attend. Should the event be held after hours at a central facility such as the (Pensacola) Civic Center, the School District may make transportation available for this event at cost. Substitute motion was seconded by Dr. Jenkins. Mrs. Stidham believed that the Ultimate PEP Rally was a positive event for students and stated that she would support the original motion which would allow the event to be held at a central facility (Pensacola Civic Center) during school hours. Mr. Bergosh believed that holding the event on individual school sites, would make it difficult to coordinate the busy schedules of all the athletes that would be involved. He urged the Board to support the original motion which would allow the event to occur at a central facility (Pensacola Civic Center).
The Board recognized Chris Sawyer and Jeff Godfrey, both of Athletes in Action of West Florida (sponsors of the Ultimate PEP Rally), who expressed their concerns with holding the event on individual school sites. They urged the Board to support the original motion which would allow the event to occur at a central facility (Pensacola Civic Center).
Upon inquiry by Dr. Jenkins, Mr. Godfrey stated that all speakers involved in the event, would sign and adhere to the Agreement and Guidelines for Guest Speakers as provided by the District. He also stated that they are willing to do the entire presentation before the Board to ensure that this event does not have a religious theme. Ms. Finkelstein stated that she did support the concept of the event and had no concerns regarding whether the event was held during or after school hours. She noted that the information provided to the Board was the same information that was presented at the May Regular Meeting, with a simple addition of the guidelines for guest speakers form. She had concerns with the invitation to the evening religious (non-denominational) event, noting that whether or not a child is invited to something or has an opportunity to go, if everybody in the county is going and they are not going that still is a concern to me. She believed that the event should include all students and stated that she would be willing to support the event if a written proposal was submitted spelling out exactly what you are going to be doing. Substitute motion failed 3 to 2, with Mr. Bergosh, Mrs. Stidham and Dr. Jenkins voting No. Original motion was approved 3 to 2, with Dr. DeWitt and Ms. Finkelstein voting No.
ADD 5. Staffing Requests Linda Finkelstein
Ms. Finkelstein moved to request the Superintendent to create a non-instructional position at Molino/Barrineau Park Elementary. Dr. DeWitt seconded the motion for discussion purposes. Ms. Finkelstein noted that both Molino Elementary and Barrineau Park Elementary schools share the same principal. She believed that due to the fact that the principal would now be involved in the coordinating of the construction of a new school (K-8 Molino/Barrineau Park) it would be appropriate to create a position to provide some non-instructional help. The Superintendent noted that he had discussed this issue with Ms. Finkelstein but we did not discuss exactly what type of position that would be. He stated that while he was not opposed to the motion, he would like to have the opportunity to discuss the issue with staff. After discussion, Ms. Finkelstein withdrew her motion and Dr. DeWitt withdrew the second.
NOTE: The following issue was discussed at the April 26, 2002 Special Meeting
Motion was made by Ms. Finkelstein, seconded by Dr. Jenkins, to retain the counselor at Woodham High School. Ms. Finkelstein explained that Woodham High School would lose one guidance counselor (a reduction from four (4) to three (3) guidance counselors for the 2002-2003 school year) which would be (due to seniority) the only minority counselor at Woodham High School. Mrs. Stidham noted that many schools with larger student populations than Woodham High School could probably use an extra guidance counselor and stated that she did not want to give Woodham one and not take into consideration the needs of other schools. Mr. Paul Fetsko, Assistant Superintendent for Curriculum and Instruction, explained that guidance counselors were allocated based on student population, which was the reason that Woodham would lose one. He noted that the staffing allocation was set up to be fair and equitable for every school and believed that the motion on the floor would treat one school differently from the rest. After discussion, the motion was approved 3 to 2, with Mr. Bergosh and Mrs. Stidham voting No.

1. Student Recommendations
Motion was made by Ms. Finkelstein, seconded by Mrs. Stidham, to approve the Superintendents recommendation for student expulsion, Item 1 (Student Number 02-135-281).
The Board recognized Mr. Lenus Michael, who requested that the Board oppose the Superintendents recommendation to expel Student Number 02-135-281 (Item 1) from all public schools of Escambia County for the 2002-2003 school year.
Upon inquiry by Dr. DeWitt, Mr. Negron explained that the Board, in order to reduce or modify the recommended penalties (as presented by the Superintendent), has to review the entire record and has to state with particularity, the reasons for changing the penalty and has to justify those reasons by citing to the record. Dr. DeWitt suggested that Mr. Michael consult with the Superintendent regarding his request. Motion was approved unanimously.
Motion by Mrs. Stidham, seconded by Dr. Jenkins, to approve the Superintendents recommendations for student expulsion, Items 2 through 25, Items 27 through 29 and Item 31, and to grant a formal hearing for Items 26 and 30, was unanimous.

18. Recommend that, consistent with the decision of the due process committee, pursuant to the authority of Section 232.26(2), Florida Statutes, student number 02-179-411 be suspended from all classes of instruction on public school grounds during regular classroom hours until such time as the pending criminal charges are concluded, at which time the Superintendent will make further recommendation regarding suspension, expulsion, or re-enrollment of this student. The indefinite suspension provided herein shall not affect the delivery of educational services to the pupil, and the pupil should be immediately enrolled in a day-time alternative educational program.
19. Recommend that, consistent with the decision of the due process committee, student number 02-180-951 be expelled from all public schools of Escambia County for the remainder of the 2001-2002 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement.
