MINUTES, OCTOBER 21, 2003
The School Board of Escambia County, Florida, convened in Public Forum at 5:30 p.m., in Room 160, at the J.E. Hall Educational Services Center, 30 East Texar Drive, Pensacola, Florida, with the following present:

5:30 p.m.
Mr. Wayne Odom gave the invocation and Mrs. Stidham led the pledge of allegiance.

Ms. Finkelstein called the
Regular Meeting to order at 5:35 p.m.
The Superintendent listed the additions, deletions, amendments and
corrections to the agenda. (see margin notes)
On motion made by Dr. DeWitt and seconded by Mrs. Bergosh, adoption of
the agenda as amended, was approved unanimously.
II.
PROPOSED ADDITIONS OR REVISIONS TO SCHOOL DISTRICT RULES
(Supplementary Minute Book, Exhibit “B”)
A. Permission to Adopt
1. Notice of Intent to Adopt
Revisions to School District Rules, Chapter 4
Motion was made by Mr. Clark, seconded by Mrs. Bergosh, to
adopt “Revisions to School District Rules, Chapter 4.” Ms. Finkelstein called for public hearing,
however there were no speakers. Motion
was approved unanimously.
2. Notice of Intent to Adopt
Amendment to School District Rule 6Gx17-(4)A.2 – Student Dress Code
Motion was made by Dr. DeWitt, seconded by Mr. Clark, to adopt
“Amendment to School District Rule 6Gx17-(4)A.2 – Student Dress Code.” Ms. Finkelstein called for public hearing,
however there were no speakers. Motion
was approved unanimously.
3. Notice of Intent
to Adopt Amendment to School District Rule 6Gx17-1.07(2) - Audit Committee
Motion was made by Dr. DeWitt, seconded by Mrs. Stidham, to
adopt “Amendment to School District Rule 6Gx17-1.07(2) – Audit Committee.” Ms. Finkelstein called for public hearing,
however there were no speakers. Motion
was approved unanimously.
4. Notice of Intent to Adopt
Emergency Amendment to School District Rule 6Gx17-2.04(3) – Position
Advertising
(NOTE: The purpose
of this rule is to insure that all vacant positions are filled on a timely
basis, by requiring the Superintendent to complete the selection process and
make an employment nomination to the School Board within 30 days of the
occurrence of a vacancy in an administrative or professional position. This rule authorizes the School Board to fill
said vacant positions upon the failure of the Superintendent to comply with the
time requirements of this rule.)
Motion was made by Mrs. Stidham, seconded by Mr. Clark, to adopt
“Emergency Amendment to School District Rule 6Gx17-2.04(3) – Position
Advertising.” Upon inquiry by Mrs. Bergosh, Mr. Negron advised
that this rule would implement Section 1012.22(1)(a)(3), which read: “If the third nomination by the district
school superintendent for any position is rejected for good cause, if the
district school superintendent fails to submit a nomination for initial
employment within a reasonable time as prescribed by the district school board,
or if the district school superintendent fails to submit a nomination for re-employment
within the time prescribed by law, the district school board may proceed on its
own motion to fill such position.”
Mrs. Bergosh questioned whether “reasonable time” was defined in the
Statutes? Mr. Negron advised that
Statutes did not define “reasonable time” but rather stated that “the district
school board could prescribe a time within which the district school
superintendent must submit a nomination before the district school board may
proceed on its own motion to fill such position.” Upon inquiry by Mrs. Bergosh, Dr. Doug
Garber, Assistant Superintendent for Human Resource Services, stated that “most
of the time would be able to do this well within the proposed time frame of 30
days, but there could be extenuating circumstances where the time frame might
need to be extended.” Ms.
Finkelstein called for public hearing, however there were no speakers. Motion was approved unanimously.

The Superintendent presented his recommendations for
Administrative Appointments/Reassignments.
Motion by Mrs. Bergosh, seconded by Dr. DeWitt, to accept the Superintendent’s recommendation for the administrative appointment of Shawn Dennis, to Assistant Superintendent/Operations, effective October 1, 2003, was approved unanimously.
Motion by Mrs. Stidham, seconded by Dr. DeWitt, to accept the Superintendent’s recommendation for the administrative appointment of Judy Heavner, to Coordinator/Program Planning, effective November 3, 2003, was approved unanimously.
Motion
by Mrs. Stidham, seconded by Mrs. Bergosh, to accept the Superintendent’s
recommendation for the administrative reassignment of Elizabeth Miller, to
Acting Director/Transportation, effective October 22, 2003, was approved

Motion was made by Mrs. Stidham, seconded by Mr. Clark, to
approve the minutes for the August 29, 2003 Special Meeting [Item 1], September

Emergency Meeting [Item 3], September 9, 2003 Special Meeting [Item 4] and
September 23, 2003 Regular Meeting [Item 7].
Mrs. Stidham did not include the minutes for the September 18, 2003
Special Meeting [Item 5] and September 19, 2003 Regular Workshop [Item 6] in
her motion, as she had not had an opportunity to review them thoroughly due to
the lateness of receiving the information.
Motion was approved unanimously.
IV.
COMMITTEE/DEPARTMENTAL REPORTS
1. Stellar Employee Recognition
The
Superintendent announced that Mr. Darren Jordan, Custodial Worker at the Dr.
Vernon McDaniel (Administrative) Building, was the Stellar Employee for the
month of October. Mr. Jordan received a
plaque and pin from the School District and a check in the amount of $100
donated by Members First Credit Union.
2. PTA Presentation
Ms. Debbie King, President, Escambia County Council PTA
(ECCPTA), gave a brief update of the recent and upcoming activities of the PTA
and expressed her appreciation to the Board and the Superintendent for their
support.
3. American Education
Week/National Education Staff Professional Day – Resolution
The Superintendent read the
following resolution:
WHEREAS, public schools are the backbone of our democracy, providing young people with the tools they need to maintain our nation’s precious values of freedom, civility and equality; and
WHEREAS, by equipping young Americans with both practical skills and broader intellectual abilities, schools give them hope for and access to a productive future; and
WHEREAS, education employees – be they custodians or teachers, bus drivers or librarians – work tirelessly to serve our children and community with care and professionalism; and
WHEREAS, schools are community linchpins that bring together adults and children, educators and volunteers, business leaders, and elected officials in our common enterprise – creating Great Public Schools for Every Child;
NOW THEREFORE, the School Board of Escambia County, Florida does hereby proclaim November 16th through 22nd, 2003 as American Education Week and Wednesday, November 19, 2003 as National Education Staff Professional Day in Escambia District Schools; and
FURTHER, a copy of this resolution shall be included in the minutes of this meeting; and
A copy of this resolution shall be presented to representatives of the Escambia Education Association and the Union of Escambia Education Staff Professionals and posted in all District facilities during said week.
Motion by Mrs. Bergosh,
seconded by Dr. DeWitt, to adopt the American Education Week/National Education
Staff Professional Day resolution, was approved unanimously.

Motion was made by Mrs. Stidham, seconded by Mr. Clark, to
approve the Superintendent’s recommendation for the instructional/professional
transfer of Nelda Segers from Bellview Middle School to the Visiting Teacher
department, effective October 22, 2003.
In answer to Mr. Clark’s question, the Superintendent stated that in
keeping with the terms of Ms. Segers’ administrative contract as an assistant
principal, she would maintain the same salary through the end of the year. Mr. Clark questioned whether “we can have an
instructional person being paid at an administrative salary?” Mr. Negron advised that “the collective
bargaining agreement provides that when there are transfers of this kind, you
can continue to receive administrative pay or the higher pay, until that
contract runs out.” Motion was approved

Motion was made by Dr.
DeWitt, seconded by Mrs. Stidham, to approve the updated Personnel Planning
Document (PPD) for the 2003-04 school year, with the deletion of the following
statement on page 49, Visiting Teachers Department (Cost Center 4424): “One Visiting Teacher position will remain
vacant 2003-2004 as a cost saving measure.”
Dr. DeWitt noted that the statement had been added to PPD as a result of
Board action from the June 9, 2003 Special Meeting. However, since the Board had approved the
Superintendent’s recommendation for the instructional/professional transfer of
Nelda Segers to that ‘vacant’ position, he believed that the statement should
be deleted. Motion was approved
unanimously.
9. Request approval for Cynthia
Jenkins to be a Community Involvement Assistant at Yniestra from September 22,
2003 through December 15, 2003. She will
be paid $9.00 per hour from the Governor’s Mentoring Initiative Grant.

ADD 6. Suspension of
Employee #153101 - Linda Finkelstein
Ms. Finkelstein made the following motion: “To suspend employee number 153101 without
pay effective immediately, with the right to pursue an administrative hearing
pursuant to Chapter 120, Florida Statutes, provided that should the employee
elect not to proceed with an administrative hearing within twenty (20) days
from today’s date, the employee shall be terminated from employment effective
October 21, 2003. The employee shall be
notified of this action in writing.”
Motion was seconded by Mrs. Stidham.
Ms. Finkelstein stated that the reason for her motion was “simply to get
this issue on the table” and to receive direction from the Board on how to
proceed. She noted that the attorney for
this employee had requested (by way of letter to the Board) that “no action be
taken until she had an opportunity to review the documentation (that had been
forwarded to her on October 20, 2003) and to speak with her client.” Because Board Members expressed a desire to
postpone this issue, Ms. Finkelstein withdrew her motion and Mrs. Stidham
withdrew the second.

Superintendent’s recommendations for Items 1 through 9, Items 11 through 16 and
Item 18, with Items 10 and 17 requesting a formal hearing, was approved
unanimously.
(1) Recommend that, consistent
with the decision of the formal hearing officer, student number 04-04-1251, be
adopted as the order of the Escambia County School Board and that student be
expelled from the public schools of Escambia County for the remainder of the
2003-2004 school year and remain in alternative education placement.
(2) Recommend that, consistent
with the decision of the due process committee, student number 04-14-521 be expelled from all public schools of
Escambia County for the remainder of the 2003-2004 school year and all of the
2004-2005 school year. It is further
recommended that the student be given the option to enroll, if qualified and if
space is available, in an alternative educational program exclusive of
regular school placement. Placement to
be at the discretion of the Superintendent and to be available as an
alternative during the full expulsion time frame.
(3) Recommend that, consistent
with the decision of the due process committee, student number 04-16-862 be
expelled from all public schools of Escambia County for the remainder of the
2003-2004 school year and all of the 2004-2005 school year. It is further
recommended that the student be given the option to enroll, if qualified and if
space is available, in an alternative educational program exclusive of
regular school placement. Placement to
be at the discretion of the Superintendent and to be available as an
alternative during the full expulsion time frame.
(4) Recommend that, consistent
with the decision of the due process committee, student number 04-17-851 be expelled from all public schools of
Escambia County for the remainder of the 2003-2004 school year and all of the
2004-2005 school year. It is further recommended that the student be
given the option to enroll, if qualified and if space is available, in an
alternative educational program exclusive of regular school placement. Placement to be at the discretion of the
Superintendent and to be available as an alternative during the full expulsion
time frame.
(5) Recommend that, consistent
with the decision of the due process committee, student number 04-18-301 be
expelled from all public schools of Escambia County for the remainder of the
2003-2004 school year. It is further recommended that the student be given the
option to enroll, if qualified and if space is available, in an alternative
educational program exclusive of regular school placement. Placement to be at the discretion of the
Superintendent and to be available as an alternative during the full expulsion
time frame.
(6) Recommend that, consistent
with the decision of the due process committee, student number 04-19-601 be expelled from all public schools of
Escambia County for the remainder of the 2003-2004 school year and all of the
2004-2005 school year. It is further recommended that the student be given the
option to enroll, if qualified and if space is available, in an alternative
educational program exclusive of regular school placement. Placement to be at the discretion of the
Superintendent and to be available as an alternative during the full expulsion

(7) Recommend that, consistent
with the decision of the due process committee, student number 04-21-591 be

(8) Recommend that, consistent

REQUEST (10) Recommend that, consistent with the
decision of the due process committee, student number 04-FORMAL 27-951
be expelled from all public schools of Escambia County for the remainder of the

regular school placement. Placement to
be at the discretion of the Superintendent and to be available as an
alternative during the full expulsion time frame.
(12) Recommend that, consistent
with the decision of the due process committee, student number 04-35-862 be expelled from all public schools of
Escambia County for the remainder of the 2003-2004 school year and all of the
2004-2005 school year. It is further recommended that the student be given the
option to enroll, if qualified and if space is available, in an alternative
educational program exclusive of regular school placement. Placement to be at the discretion of the
Superintendent and to be available as an alternative during the full expulsion
time frame.
(13) Recommend that, consistent
with the decision of the due process committee, pursuant to the authority of
Section 232.26(2), Florida Statutes, student number 04-36-411 be suspended from
all classes of instruction on public school grounds during regular classroom
hours until such time as the pending criminal charges are concluded, at which
time the Superintendent will make further recommendation regarding suspension,
expulsion, or re-enrollment of this student.
The indefinite suspension provided herein shall not affect the delivery
of educational services to the pupil, and the pupil should be immediately
enrolled in a day-time alternative educational program.
(14) Recommend that, consistent
with the decision of the due process committee, student number 04-38-411 be expelled from all public schools of
Escambia County for the remainder of the 2003-2004 school year and all of the
2004-2005 school year. It is further recommended that the student be given the
option to enroll, if qualified and if space is available, in an alternative
educational program exclusive of regular school placement. Placement to be at the discretion of the
Superintendent and to be available as an alternative during the full expulsion
time frame.
(15) Recommend that, consistent
with the decision of the due process committee, student number 04-40-121 be expelled from all public schools of
Escambia County for the remainder of the 2003-2004 school year and all of the
2004-2005 school year. It is further recommended that the student be given the
option to enroll, if qualified and if space is available, in an alternative
educational program exclusive of regular school placement. Placement to be at the discretion of the
Superintendent and to be available as an alternative during the full expulsion

(16) Recommend that, consistent
