MINUTES, NOVEMBER 18, 2003

            The School Board of Escambia County, Florida, convened in Public Forum at 5:40 p.m., in Room 160, at the J.E. Hall Educational Services Center, 30 East Texar Drive, Pensacola, Florida, with the following present:

Mrs. Stidham called the Public Forum to order at 5:40 p.m.

INVOCATION AND PLEDGE OF ALLEGIANCE

            Mrs. Peggy Pilcher gave the invocation and Mr. Negron led the pledge of allegiance.

Partnership Agreement Signing

Mrs. Peggy Pilcher, Coordinator of Volunteer and Business Partnerships, gave a short synopsis of the support provided by Gulf Power as a District-wide “Partner in Education”.  Mrs. Stidham and the Superintendent joined with representatives of Gulf Power in signing a partnership agreement with the School District.

     I.               CALL TO ORDER/ADOPTION OF AGENDA

Mrs. Stidham called the Regular Meeting to order at 6:15 p.m.  (NOTE: See margin notes for additions, deletions, amendments and corrections to the agenda.)  On motion made by Dr. DeWitt and seconded by Mr. Clark, adoption of the agenda as amended, was approved unanimously.

   II.               PROPOSED ADDITIONS OR REVISIONS TO SCHOOL DISTRICT RULES

(Supplementary Minute Book, Exhibit “B”)

A.     Permission to Adopt

AMENDED    1.         Notice of Intent to Adopt Amendment to School District Rule 6Gx17-7.09 – Student Progression Plan

      Motion was made by Mr. Clark, seconded by Mrs. Bergosh, to adopt “Amendment to School District Rule 6Gx17-7.09 – Student Progression Plan.”  Mrs. Stidham called for public hearing, however there were no speakers.  Motion was approved unanimously.

AMENDED    2.         Notice of Intent to Adopt Revisions to School District Rules, Chapter 6

      Motion was made by Mr. Clark, seconded by Mrs. Bergosh, to adopt “Revisions to School District Rules, Chapter 6.”  Mrs. Stidham called for public hearing, however there were no speakers.  Motion was approved unanimously.

3.       Notice of Intent to Adopt Amendment to School District Rule 6Gx17-2.04(9) - Hiring Freeze

      Motion was made by Dr. DeWitt, seconded by Mr. Clark, to adopt “Amendment to School District Rule 6G17-2.04(9) – Hiring Freeze.”  Mrs. Stidham called for public hearing, however there were no speakers.  Motion was approved unanimously.   

4.       Notice of Intent to Adopt Amendment to School District Rule 6Gx17 – 2.12 (1)(d)(e)(f)(g)(h)(i)(j);(2)(b)(c)(d)(e);(3)(b)(c)(d)(e)(f)(g)(h)(i)(j)(k(1)(2)(3)(1);(4) – Community and Parent Involvement

      Motion was made by Dr. DeWitt, seconded by Mr. Clark, to adopt “Amendment to School District Rule 6Gx17 – 2.12 (1)(d)(e)(f)(g)(h)(i)(j);(2)(b)(c)(d)(e);(3)(b)(c)(d)(e)(f)(g)(h)(i)(j)(k(1)(2)(3)(1);(4) – Community and Parent Involvement.”  Mrs. Stidham called for public hearing, however there were no speakers.  Motion was approved unanimously. 

5.       Notice of Intent to Adopt Amendment to School District Rule 6Gx17-2.04(3) – Position Advertising

      (NOTE: The purpose of this rule is to insure that all vacant positions are filled on a timely basis, by requiring the Superintendent to complete the selection process and make an employment nomination to the School Board within 30 days of the occurrence of a vacancy in an administrative or professional position.  This rule authorizes the School Board to fill said vacant positions upon the failure of the Superintendent to comply with the time requirements of this rule.)  Motion was made by Mr. Clark, seconded by Dr. DeWitt, to adopt “Amendment to School District Rule 6Gx17-2.04(3) – Position Advertising.”  Mrs. Bergosh expressed concerns with the proposed time frame of 30 days.  She moved to amend the motion on the floor, to adopt “Amendment to School District Rule 6Gx17-2.04(3) – Position Advertising,” but “to include a time range of 30 to 45 days, and should the Superintendent not fill the vacancy within 30 days, he/she shall provide notice to the School Board of the status.”   Amended motion died for lack of a second.  After discussion, Mrs. Stidham called for public hearing, however there were no speakers.  Motion was approved 4 to 1, with Mrs. Bergosh voting “No.” 

6.       Notice of Intent to Adopt Amendment to School District Rule 6Gx17-2.32(8) and (9) - Political Activities of Personnel

      Motion was made by Dr. DeWitt, seconded by Mrs. Bergosh, to adopt “Amendment to School District Rule 6Gx17-2.32(8) and (9) - Political Activities of Personnel.”  Mrs. Stidham called for public hearing, however there were no speakers.  Motion was approved unanimously.  


B.   Permission to Advertise

AMENDED    1.         Notice of Intent to Advertise Revisions to School District Rules, Chapter 5

      Motion by Dr. DeWitt, seconded by Mr. Clark, to approve for advertising “Revisions to School District Rules, Chapter 5,” was unanimous.

2.       Notice of Intent to Advertise mandated revisions by the Florida Legislature to the prescribed publication “Special Programs and Procedures for Exceptional Students” as implemented by School District Rule 6Gx17-4.02

      Motion was made by Dr. DeWitt, seconded by Mrs. Bergosh, to approve for advertising, mandated revisions by the Florida Legislature to the prescribed publication “Special Programs and Procedures for Exception Students” as implemented by School District Rule 6Gx17-4.02.  Motion was approved unanimously.

            C.   Miscellaneous

1.       Notice of Intent to Adopt the Escambia School District Tentative Facilities Work Program (as publicly advertised for adoption on this date)

Motion was made by Dr. DeWitt, seconded by Mrs. Bergosh, to adopt the “Escambia School District Tentative Facilities Work Program.”  Mrs. Stidham called for public hearing, however there were no speakers.  Motion was approved unanimously.   

THE FOLLOWING ITEM WILL BE MOVED FORWARD: Administrative Appointments (Item VII.B.1)

The Superintendent presented his recommendations for Administrative Appointments/Reassignments.

      Motion by Dr. DeWitt, seconded by Mrs. Bergosh, to accept the Superintendent’s recommendation for the administrative appointment of Keith Leonard, from Physical Education Teacher/Tate High School to Chief Negotiator, effective November 19, 2003, was approved unanimously.   

      Motion by Ms. Finkelstein, seconded by Dr. DeWitt, to accept the Superintendent’s recommendation for the administrative appointment of Sandra Moore, from Assistant Elementary School/Hellen Caro Elementary School to Principal/Hellen Caro Elementary School, effective January 1, 2004, was approved unanimously. 

      Motion by Ms. Finkelstein, seconded by Mr. Clark, to accept the Superintendent’s recommendation for the administrative appointment of Larry Reid, from Acting Principal/Wedgewood to Assistant Principal/Wedgewood, effective November 03, 2003, was approved unanimously. 

      Motion by Mrs. Stidham, seconded by Dr. DeWitt, to accept the Superintendent’s recommendation for the administrative appointment of Frank Murphy, from Dean/Escambia High School to Assistant Principal/Escambia High School, effective November 19, 2003, was approved unanimously.

      Motion by Dr. DeWitt, seconded by Mrs. Bergosh, to approve the minutes for the September 18, 2003 Special Meeting [Item 1], September 19, 2003 Regular Workshop [Item 2], September 30, 2003 Special Meeting [Item 3], October 6, 2003 Special Workshop [Item 4] and October 21, 2003 Regular Meeting [Item 7], was unanimous.     

IV.               COMMITTEE/DEPARTMENTAL REPORTS

1.       Stellar Employee Recognition

      The Superintendent announced that Ms. Debra Odom, School Bus Operator, was the Stellar Employee for the month of November.  Ms. Odom received a plaque and pin from the School District and a check in the amount of $100 donated by Members First Credit Union.

2.       PTA Presentation

      Ms. Debbie King, President, Escambia County Council PTA (ECCPTA), gave a brief update of the recent and upcoming activities of the PTA and expressed her appreciation to the Board and the Superintendent for their support.

      Mrs. Stidham moved to “establish a position for and approve the job description of Food Services Compliance Specialist on the Professional Salary Schedule, with the position to sunset on June 30, 2004.”  Ms. Finkelstein seconded the motion for discussion purposes.  Mrs. Stidham explained that if this position was not utilized for the specific purpose that it was being established (re: Workers Compensation issue), then her motion would ensure that it would sunset on June 30, 2004.  She noted that her motion “would give staff the ability to do what they need to do, yet the position would not be there on a permanent basis.”  Motion was approved unanimously. 

                             12.   Request approval to revise the attached job description of Chief Negotiator.

13.      For Board Information: Attached is a draft of the Escambia County School District Employee Code of Ethics.

      Motion was made by Dr. DeWitt, seconded by Ms. Finkelstein, to defer the following items to Executive Session: “Lump Sum Settlement – Workers Compensation” (Item c), “Workers Compensation Medical Bill” (Item d), and “Lump Sum Settlement – Workers Compensation” (Item e).  Mrs. Stidham believed that information provided by the Risk Management Department regarding those items was sufficient for her to make a decision and therefore, she did not see a need to defer them to Executive Session.  Upon inquiry by Dr. DeWitt, Mr. Kevin Windham, Director of Risk Management, explained the “time sensitive” nature of “Item d”, noting the District had forty-five (45) days from the date received, to pay all Workers Compensation medical bills.  Referring to “Item c” and “Item e”, Mr. Marvin Edwards, Claims Adjuster, stated that while there was “really no time limit on settlements,” he did believe that action on those items should be taken as soon as possible.  After further discussion, Dr. DeWitt offered to withdraw his motion, however Ms. Finkelstein did not agree.  Motion failed 4 to 1 with Mrs. Stidham, Dr. DeWitt, Mr. Clark and Mrs. Bergosh voting “No.”  Motion by Dr. DeWitt, seconded by Mrs. Bergosh, to approve “Lump Sum Settlement – Workers Compensation” (Item c), “Workers Compensation Medical Bill” (Item d), and “Lump Sum Settlement – Workers Compensation” (Item e), was approved 4 to 1 with Ms. Finkelstein voting “No.”

1.   School Board Members Salaries for 2003-2004 as Recommended by Florida School Boards Association

            Motion by Ms. Finkelstein, seconded by Mr. Clark, that school board members salaries for 2003-2004 be “frozen at the 2002-2003 level,” was approved unanimously.  

2.   Establishment of Committee to Develop Recommendations for Solutions to Problems Related to Childhood Obesity – John DeWitt  

            Motion was made by Dr. DeWitt, seconded by Ms. Finkelstein, to approve the establishment of a committee to develop recommendations for solutions to problems related to childhood obesity.” Dr. DeWitt noted that each Board Member and the Superintendent would need to appoint three individuals to the committee as soon as possible.  Motion was approved unanimously.

      Motion by Dr. DeWitt, seconded by Mrs. Bergosh, to accept the Superintendent’s recommendations for Items 1 through 15, was approved unanimously.   

(1)    Recommend that, consistent with the decision of the formal hearing officer, student number 04-42-061 be adopted as the order of the Escambia County School Board and that the student be expelled from the public schools of Escambia County for the remainder of the 2003-2004 school year and remain in alternative education placement.

(2)    Recommend that, consistent with the decision of the due process committee, student number 04-47-561  be expelled from all public schools of Escambia County for the remainder of the 2003-2004 school year and all of the 2004-2005 school year.  It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alterna­tive educa­tional program exclusive of regular school placement.  Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.

(3)    Recommend that, consistent with the decision of the due process committee, student number 04-48-1221 be expelled from all public schools of Escambia County for the remainder of the 2003-2004 school year and all of the 2004-2005 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alterna­tive educa­tional program exclusive of regular school placement.  Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.

(4)    Recommend that, consistent with the decision of the due process committee, student number 04-49-521  be expelled from all public schools of Escambia County for the remainder of the 2003-2004 school year and all of the 2004-2005  school year.  It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alterna­tive educa­tional program exclusive of regular school placement.  Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.

(5)    Recommend that, consistent with the decision of the due process committee, student number 04-50-521 be expelled from all public schools of Escambia County for the remainder of the 2003-2004 school year and all of the 2004-2005 school year. ADD          3.   Recommend that instructional employee number 588591 be suspended with pay until the next regularly scheduled Board Meeting pending an investigation into allegations of falsification of and/or failure to provide documentation required under federal and state law for Exceptional Student Education Students. 

      Motion by Mrs. Stidham, seconded by Mr. Clark, to accept the Superintendent’s recommendation that instructional employee number 588591 be suspended with pay until the next regularly schedule Board Meeting pending an investigation into allegations of falsification of and/or failure to provide documentation required under federal and state law for Exceptional Student Education Students, was approved unanimously. 

ADD          4.   Recommend that employment of instructional employee number 436166 be terminated for cause effective Wednesday, November 19, 2003, as a consequence of misconduct as more fully set forth in the notice letter to the employee of November 10, 2003

                              Motion by Dr. DeWitt, seconded by Mrs. Bergosh, to accept the Superintendent’s recommendation that the employment of instructional employee number 436166 be terminated for cause effective Wednesday, November 19, 2003, as a consequence of misconduct as more fully set forth in the notice letter to the employee of November 10, 2003, was approved unanimously. 

ADD          5.   Recommend that employment of instructional employee number 689819 be terminated for cause effective Wednesday, November 19, 2003, as a consequence of misconduct as more fully set forth in the notice letter to the employee of November 10, 2003.
